Terms and conditions
Terms for using the NOBILITH platform and for purchases, auctions, custody and delivery.
Entries marked [PENDING] will be completed before public launch.
1. Provider and scope
The contracting party is [PENDING] (full company name), NOBILITH, [PENDING] (address), Switzerland. Email: info@nobilithworld.com
These terms cover the website, the member area, the mobile applications, the Private Market, primary sales, auctions, concierge services and custody and delivery.
Additional terms may apply to individual areas (auction, custody, delivery, concierge and partner or consignment terms). In case of conflict the specific terms prevail.
2. Business model
NOBILITH is a platform for individually documented and certified gemstones and offers its own primary sales, Private Market transactions between admitted members, curated auctions of its own and partner-consigned gemstones, concierge and search services, digital product dossiers and custody with organised delivery.
NOBILITH offers no investment advice, no guaranteed return and no assurance of a particular development in value or resale liquidity.
3. Account and membership
A personal account is required for protected areas, purchases, bids and other transactions. The account is linked to one email address; each sign-in address can be used for one account only. Membership is free of charge.
Registration: you provide your email address and a password of at least 12 characters. The account is created only once you open the link in the confirmation email within 24 hours. During set-up you connect an authenticator app (for example the «Passwords» app on iPhone) and receive 10 single-use recovery codes. Keep them safely and separately from your device.
Sign-in: you always sign in with your password and a six-digit code from your authenticator app. NOBILITH does not send sign-in codes by email or text message. After several failed attempts, sign-in is temporarily blocked; repeated failures extend the block. If fewer than three recovery codes remain, you will be asked to generate new ones.
Replacing the password or authenticator app: you reset a forgotten password via a link sent to your confirmed email address. If you have lost your authenticator app, you can set it up again immediately with a recovery code. Without a recovery code, NOBILITH can initiate the reset at your request; for security reasons a waiting period of 24 hours then applies, and you are informed by email in advance so that you can stop an unauthorised attempt.
App: the NOBILITH app for iPhone and Android offers the same customer functions as the website. Push notifications and the app lock with Face ID, Touch ID or fingerprint are optional and can be changed in the settings at any time. The app lock does not replace sign-in. The partner portal for consignors is available in the browser only.
Notifications: you receive important events (for example admission, access code, winning bid, invoice, suspension or a withdrawn lot) as a message in your account and, where provided, by email from info@nobilithworld.com and as a push notification.
You exercise your data rights (access, copy of your data, deletion) directly in your account under «Security»; details are set out in the privacy policy.
You undertake:
- to provide truthful information and to keep your credentials, authenticator app and recovery codes confidential
- not to transfer the account and to report security incidents without delay to info@nobilithworld.com
- not to use third-party payment or identity data
4. Age and identification
Purchases, sales, bids and auctions require legal age.
NOBILITH may require identity verification at any time, in particular for high transaction values, auctions, ownership transfers, deliveries, international shipments, unusual payment or usage behaviour and statutory review duties. Without the required identification a transaction may be refused or withheld.
Identity is verified in the NOBILITH app using the chip in your identity document and a selfie; documents without a chip are verified by NOBILITH in another way. Customer due diligence also includes a self-declaration on a politically exposed position, your source of funds and ongoing screening against the SECO sanctions list.
From a transaction value of CHF 100,000 (one purchase, a bidding limit or the total of purchases within 12 months), if you declare a politically exposed position or on request, NOBILITH requires documents on the source of funds. The transaction concerned may be held until they have been reviewed. While a sanctions screening review is open, purchases, auction registrations and deliveries are temporarily blocked. NOBILITH may adjust the threshold; the value shown in your account applies.
5. Gemstones and documentation
NOBILITH carries only gemstones that have been recorded, reviewed and documented with a suitable laboratory report. Possible laboratories include GIA, GRS, Gübelin, SSEF and ICA GemLab.
The specific laboratory report and the individual product dossier always prevail. General Academy content does not replace a laboratory report. Origin statements are adopted only where covered by documents or a laboratory report.
6. Primary sale
In a primary sale NOBILITH sells its own or a controlled gemstone directly to you. The contract is concluded once NOBILITH confirms the order, identity verification is complete, the payment terms are accepted and payment or payment release is confirmed.
Ownership passes only after full payment confirmation and fulfilment of the prescribed release conditions.
7. Private Market
The Private Market allows admitted members to trade gemstones recorded and admitted on the platform.
The platform fee is 3 % of the successful trade price, including Swiss VAT. It is charged to the seller and deducted from the proceeds; the buyer pays no additional Private Market fee.
NOBILITH may refuse a transaction where identity or compliance checks are open, the gemstone is insufficiently documented, payment release is missing, custody or ownership is unclear, or a security or legal risk exists.
Listings: a listing is created by the seller alone; price and type of offer are determined solely by the seller. Listings are never created automatically, including after a purchase. A listing may be created by anyone who owns a gemstone held under seal in custody – acquired by direct sale, auction or in the Private Market. Gemstones consigned by auction partners are sold only through the NOBILITH auction.
Gemstones without a listing: a gemstone held in custody for you can be found in the Private Market only with your express consent. The Vault asks for it after every purchase; without consent the gemstone remains invisible, and you may withdraw consent at any time. Only the gemstone's attributes are shown, never your name; likewise the person making an offer remains anonymous to you.
Offers and negotiation: offers start at CHF 1,000 and are binding. The party addressed may accept, decline or make a counter-offer; each side has 72 hours to respond, for at most six rounds. On acceptance the purchase is concluded on the terms of this section, including the platform fee; payment follows in the Private Market.
8. Auctions
Admission: to bid you need a confirmed account with completed identity verification and an auction admission. For admission, NOBILITH verifies the source of your funds with a verification provider and sets a bidding limit. Registration for a specific auction is possible until 72 hours before it starts. When registering, you reserve funds in the amount of your bidding limit with our payment partner. Before the start, you receive a personal access code for the auction room.
Agency sale: NOBILITH auctions consigned gemstones as an intermediary in the name and for the account of the consignor; the contract of sale is concluded between you and the consignor. Every lot carries a symbol in the catalogue, on the lot page and in the auction room: a gold hexagon with the NOBILITH mark means «property of NOBILITH» – NOBILITH sells these gemstones in its own name; the outline of a cut gemstone means «consigned» – NOBILITH acts as an intermediary in the name and for the account of the consignor. Tapping or hovering over the symbol shows this explanation. Consignors may not bid on their own lots.
Taxes and evidence: the hammer price and the buyer's premium are exclusive of Swiss VAT while the gemstone remains in the bonded warehouse. On delivery within Switzerland you owe import VAT as the importer; NOBILITH advances it for you and forwards it to customs (pass-through item, shown in the quote). On delivery abroad, NOBILITH records the export evidence in the gemstone's dossier.
Bids: a bid placed is binding. It must exceed the current highest bid by at least the displayed increment and may not exceed your bidding limit including the buyer's premium. If a bid is placed shortly before a lot closes, the lot is extended by up to five minutes; the extension may repeat. An auction may provide for a reserve price; if it is not reached, the lot is not sold.
Conduct: the auction is accompanied by a virtual auctioneer and supervised by NOBILITH Operations. NOBILITH may interrupt the auction (pause or emergency stop), display announcements, withdraw a lot for good cause, suspend a bidder in case of suspected abuse and annul an obvious erroneous bid; the next highest valid bid then applies. Every intervention is logged with its reason, and affected bidders are informed. There is no entitlement to a winning bid.
Trial auctions: NOBILITH may hold internal trial auctions for training and testing. They are marked as such, not public and not accessible to customers; no sale, payment obligation or transfer of ownership arises.
9. Auction fees
A buyer's premium of 2.5% is charged on the hammer price. The rate applicable to each auction is shown on the auction page before it starts; the value shown there prevails.
For gemstones consigned by partners, the consignor commission is 10% of the hammer price. It is deducted from the consignor's proceeds and not added to the hammer price. For consignors domiciled or with their registered office in Switzerland or Liechtenstein the commission includes Swiss VAT; for consignors with confirmed domicile abroad the place of supply is abroad and the commission is charged without Swiss VAT. Consignors are additionally subject to the consignment terms in the partner portal.
10. Winning bid, payment and non-payment
The winning bid creates a binding obligation to pay the hammer price and the buyer's premium. After the auction ends, the amount is collected from your reserved funds; reservations not needed are released.
If collection is not possible, you receive an invoice. The amount is payable by bank transfer within 5 Swiss banking days; the deadline ends at 23:59 (Zurich time) on the 5th banking day. Banking days are Monday to Friday excluding the Swiss bank holidays according to SIX (New Year's Day and Berchtold's Day, Good Friday, Easter Monday, 1 May, Ascension Day, Whit Monday, 1 August, Christmas Day and St Stephen's Day). The payment details are shown in your account under «My auctions» and in the invoice email.
If you do not pay on time, NOBILITH may cancel the purchase, release your funds, exclude you from future auctions or make future admission subject to a security deposit, and claim documented costs.
Offer to the underbidder: if a purchase is cancelled for non-payment, NOBILITH may offer the gemstone to the next highest valid bidder at that bidder's highest bid plus buyer's premium. The offer is optional and valid for 48 hours. If you accept it, the purchase is concluded at that price and you receive an invoice payable within 5 banking days. If you decline or let the deadline pass, the gemstone remains available for a later auction.
Ownership: once payment has been received, the gemstone is handed over to the custodian in the bonded warehouse. Ownership passes to you only upon the custodian's confirmation (section 14).
11. Payment methods
Bank transfer, credit card, PayPal and further expressly offered methods are provided for. Payments may be processed via external payment providers.
A payment is considered fulfilled only once NOBILITH or the appointed provider confirms receipt or release. NOBILITH holds no freely available customer balance.
12. Custody
After purchase the gemstone may remain in Swiss custody, intended to be a bonded warehouse or a comparable qualified custodian.
- The current owner remains recorded in the register.
- The current owner bears the agreed storage and insurance costs.
- The gemstone is held insured and the custody status documented.
- Delivery takes place only after confirmed release.
- Storage prices, insurance terms and notice periods: [PENDING], in the individual offer and the custody terms.
13. Delivery, taxes and customs
You may choose between custody in Switzerland, delivery within Switzerland and export abroad.
As long as a gemstone remains in the bonded warehouse, purchase prices, hammer prices and prices on the Private Market are exclusive of Swiss VAT. VAT is charged as import VAT only when you request delivery within Switzerland; it is calculated on the value including transport and insurance and invoiced before release. The gemstone can be resold without leaving the bonded warehouse. Buyer's premium, commissions and fees are charged as stated for the respective service.
For delivery within Switzerland, Swiss VAT of currently 8.1 %, transport, insurance, customs and clearance costs and custodian costs may apply. On export, import taxes, customs and local fees may arise in the destination country; these are borne by the recipient unless agreed otherwise.
Delivery takes place only after full payment confirmation, clarified tax and customs treatment, insurance confirmation, internal release and documented handover to the logistics partner.
Delivery is made exclusively to the account holder at the address given when requesting the withdrawal; handover only against presentation of an official identity document. The address cannot be changed after the request – a different address requires a new request. After delivery you may dispose of the gemstone freely, for example give it as a gift.
14. Transfer of ownership
The change of ownership is recorded in the NOBILITH system only after confirmed payment and successful transaction release.
Register entry and Ownership Pass are means of evidence and documentation. They do not replace legally required contracts, custody records or proof of ownership.
15. Laboratory reports, authenticity and warranty
NOBILITH adopts the details of the respective laboratory report to the best of its knowledge and with reference. No responsibility is taken for later corrections by a laboratory, provided the details were adopted correctly at the time of publication. Where deviations are substantiated, a renewed laboratory examination may be requested.
NOBILITH warrants that the expressly assured characteristics match the contract documents. No assurance is given as to a particular development in value, a later sale price, liquidity at any time, a particular market opinion, an origin that is not expressly documented, or a particular assessment by another laboratory.
Defects or deviations must be reported without delay after discovery. Mandatory statutory warranty rights remain reserved.
16. Return and withdrawal
No voluntary general right of return is assured, in particular not for individually selected gemstones, completed auctions, concierge or search services already rendered, individually commissioned deliveries and custody services already set up.
Mandatory statutory rights for defects, wrong delivery or missing assured characteristics remain reserved. Mandatory local consumer rights may apply to customers in the EU or other countries; these are not excluded.
17. Concierge and Private Search
Depending on the client's choice, consultations take place by phone or video meeting. Appointments can be booked in the account; bookable times depend on the team's availability. Meetings are recorded only with the prior consent of all participants.
Search mandate: with the Private Search, NOBILITH searches international sellers for a gemstone matching your brief (not its own stock, which you can view yourself). Once NOBILITH accepts the mandate, a search deposit of CHF 500 is due; the search begins once it has been received. If a purchase is concluded, the search deposit is credited against the price. If the search ends without a purchase, NOBILITH decides case by case whether to refund or retain it; a retained search deposit is consideration for the search service and is subject to VAT.
Find and offer: when NOBILITH finds a suitable gemstone, you receive a personal offer in your client area with images, videos, laboratory report, price and payment plan, as well as an e-mail. The price includes purchase, transport, insurance and import into the Swiss bonded warehouse. The offer is valid for 5 days, during which the gemstone is reserved for you. You receive a reminder before it expires. You can order, request a consultation or decline.
Order and down payment: by ordering, you buy the gemstone bindingly at the offered price. You make a down payment of 30% within 10 days (QR bill); if it is not received in time, the order lapses at no further cost. Once the down payment has been received, NOBILITH purchases the gemstone in its own name and brings it, insured, to the bonded warehouse. NOBILITH bears the transport and loss risk until ownership passes.
Final payment and ownership: after arrival and inspection in the bonded warehouse you receive the invoice for the remainder, payable within 10 days. Upon full payment NOBILITH notifies the bonded warehouse of the transfer of ownership; ownership passes to you upon its confirmation (section 14). You then choose whether the gemstone is kept in custody in the bonded warehouse (section 12) or delivered (section 13, Switzerland or abroad, with the details required for this).
Non-payment: if the remainder is not paid in time, the down payment is forfeited as compensation for purchase, transport and reservation; the gemstone remains the property of NOBILITH and you are released from the final payment. The search deposit is then treated as a search without purchase. Further claims remain reserved where the loss exceeds the down payment.
A search mandate is no guarantee that a particular gemstone can be found or offered at a particular price.
18. Availability, prohibited use and liability
NOBILITH aims for reliable availability. Temporary interruptions due to maintenance, security measures, technical faults, external providers, network or power failures, official requirements or force majeure are possible.
Prohibited are in particular false identity details, use of third-party accounts, manipulation of bids, circumvention of security mechanisms, automated attacks, abusive queries, deception of other members, money laundering and fraud, and infringement of copyright, trade mark or personality rights.
NOBILITH is liable within the limits of the law for damage caused intentionally or through gross negligence. No liability is accepted, as far as permitted, for indirect damage, lost profit, market changes, exchange rates, value development or the ability to resell. Mandatory liability provisions remain reserved.
19. Suspension, termination and account deletion
NOBILITH may suspend or terminate an account in the event of a breach of these terms, non-payment, unconfirmed identity details, security or compliance risks, legal reasons or suspected abuse. An exclusion from future auctions for non-payment is communicated to you and may be lifted again by NOBILITH.
You can request the deletion of your account at any time yourself: in your account under «Security», on any device and in the app. After the request, a period of 30 days runs during which you can withdraw it. Outstanding payment obligations, ownership rights, custody fees and statutory retention duties remain unaffected; if such reasons exist, deletion is deferred and the reasons are communicated to you.
20. Law, jurisdiction and final provisions
Swiss law applies, subject to mandatory provisions of the state in which a consumer has their habitual residence.
Place of jurisdiction: [PENDING] (to be added once the registered office is determined). Mandatory statutory rules on jurisdiction apply to consumers.
NOBILITH may adapt these terms when the business model, platform, legal requirements or providers change; for transactions already concluded, the version valid at conclusion applies. Should a provision be invalid, the remaining provisions remain effective.
